Terms & Conditions

These Terms and Conditions outline the terms of use and services provided by MILPAQ, a platform operated by 305 Aero Supplies LLC. By accessing or using MILPAQ, you agree to comply with the following terms.

1. Service Provision

  • 305 Aero Supplies LLC provides packaging services and solutions in compliance with Military Standard 2073 and Military Standard 129. Services are rendered based on the packaging instructions cited in the relevant contract.

2. Payment Terms

  • Payment is due upon receipt of the invoice. All invoices must be paid immediately without any grace period.

  • A minimum order value of $100 applies to all services offered by MILPAQ.

  • Failure to make timely payment may result in suspension of services.

3. Contractor’s Representation and Warranty

  • The Contractor warrants that all products provided for packaging meet the requirements set forth in the contract with the U.S. government.

  • 305 Aero Supplies LLC guarantees compliance with military packaging standards. Any valid Product Quality Deficiency Report (PQDR) related to packaging, marking, or traffic management errors will be resolved at no additional cost to the Contractor.

4. Limitation of Liability

  • 305 Aero Supplies LLC shall not be held liable for any issues beyond the packaging services provided, including but not limited to product quality, installation failures, or incorrect items.

  • Liability is limited strictly to services for ensuring compliance with military packaging requirements.

5. Source Inspection Services

  • 305 Aero Supplies LLC assumes no responsibility for the quality of products when providing source inspection services. It is the Contractor’s responsibility to ensure product compliance.

6. Indemnification

  • The Contractor agrees to indemnify and hold harmless 305 Aero Supplies LLC from any claims, disputes, or legal actions arising from the purchase or use of its products and services. This includes claims from the government or third parties regarding incorrect parts, product defects, or violations of ITAR (International Traffic in Arms Regulations).

7. Inspection and Acceptance

  • The Contractor is responsible for conducting visual inspections of packaged products at the designated facility. This inspection may include representatives of the U.S. government.

  • Upon inspection and acceptance of the product, no warranties are provided. Any rejection due to missing documentation or noncompliance will incur additional inspection charges.

8. Documentation

  • The Contractor must ensure that all documentation related to traceability and compliance is genuine, accurate, and complete.

  • 305 Aero Supplies LLC inspects products for type, count, and condition based on contract requirements.

9. Credit Terms and Guaranty

  • The Contractor guarantees payment for all debts, including any collection costs incurred by 305 Aero Supplies LLC.

  • In case of disputes, the Contractor agrees to pay reasonable attorney fees and court costs.

10. Contract Acceptance

  • By delivering merchandise to 305 Aero Supplies LLC for packaging, the Contractor acknowledges and accepts these Terms and Conditions, including any personal guaranty obligations.

11. Dispute Resolution

  • All disputes related to these Terms and Conditions shall be governed by the laws of the State of Florida.

  • Any legal actions must be resolved exclusively in the state court located in Miami-Dade County, Florida.

12. Credit Card Authorization

  • The Contractor authorizes 305 Aero Supplies LLC to charge the provided credit card for the agreed amount.

  • This authorization is valid for one-time use only, and the Contractor agrees not to dispute the charge if it corresponds to the agreed terms.

13. Additional Terms

  • 305 Aero Supplies LLC reserves the right to amend these Terms and Conditions at any time. Updated terms will be made available on the MILPAQ platform. Continued use of the platform indicates acceptance of any changes.

  • The Contractor is responsible for ensuring that all packaging requirements and contract instructions are clearly communicated.
